This Privacy Policy explains how Firgos collects, uses, stores and otherwise handles information provided through FirgosCuracao.com, the Firgos B2B Online Platform and related customer-service processes. It applies to business customers, authorized users, prospective business customers and persons who contact Firgos through the website or associated online forms.

The B2B platform is intended for registered business customers. An online account is linked to the applicable Firgos customer account/customer number, and orders submitted through that account are treated as activity on behalf of the registered business.

2. Information We May Collect

Depending on the service or interaction, Firgos may collect and process the following information:

Business identification information, including registered company name, Chamber of Commerce (KvK) information and other company-registration information required for customer onboarding.

Firgos customer number and information needed to match the webshop account to the correct customer account.

Authorized user and Point of Contact (POC) information, including name, business email address, telephone number, role and account-access details.

Business, billing, pickup and delivery addresses, including branch/location information where a customer operates more than one location.

Order information, including products, quantities, order history, delivery or pickup instructions, comments, backorder requests and transaction references.

Commercial account information relevant to the order process, such as the payment terms assigned to the customer account. The webshop does not independently create or change approved credit terms.

Customer-service information submitted through return, claim, quality, feedback, donation/sponsorship or other website forms, including supporting photographs or documents where requested.

Account acceptance records, including customer number, authorized user/email, date and time of acceptance and the version of the applicable Terms & Conditions accepted.

Technical information generated through use of the website, such as information reasonably required for website operation, security, troubleshooting and account access.

3. Why Firgos Uses This Information

Firgos may use information collected through the website and B2B platform to:

Verify and administer business-customer registrations and webshop access.

Link authorized webshop users to the correct Firgos customer account and reduce unauthorized use of corporate accounts.

Process, prepare and fulfill orders for delivery or pickup and communicate order status or operational changes.

Confirm delivery locations, contact persons and route-related information.

Apply the commercial and payment conditions assigned to the relevant customer account.

Handle backorder requests and notify customers when requested products become available.

Process returns, exchanges, delivery errors, product-quality claims and other customer-service requests in accordance with applicable Firgos policies.

Respond to customer feedback, questions and service-improvement requests.

Maintain records needed for operational, financial, security and audit purposes.

Protect Firgos, its customers and users against unauthorized account access, misuse, fraud or security incidents.

Maintain and improve the functionality and reliability of FirgosCuracao.com and the B2B ordering process.

4. Account Access and Authorized Users

Customers are responsible for providing accurate information and for identifying persons authorized to use their corporate B2B account. Where employee or representative access is permitted, the relevant user information should be maintained in the customer profile or otherwise approved through Firgos procedures.

Customers should promptly remove or report users who are no longer authorized. Firgos may take reasonable steps to verify account information or restrict access where unauthorized or suspicious use is identified.

5. How Information May Be Used Across Firgos Systems

Information submitted through the website may be used within Firgos systems and operational processes where necessary to administer the customer relationship, process orders, support delivery, maintain customer records, manage customer service and provide reporting.

Firgos currently uses business systems and service providers in connection with its sales and website processes, including its website/e-commerce environment and internal customer, sales and order-management systems. Information should only be shared or synchronized to the extent required for the relevant business purpose and subject to the access controls applicable to those systems.

6. Payment Information

Payment conditions displayed or applied to an order are based on the customer account and the payment terms approved by Firgos. New B2B customers are initially subject to COD terms unless different terms have been formally approved.

Firgos deliveries are cashless and drivers do not accept cash. Where electronic/card payment is used, payment processing may involve the applicable payment/POS provider. Firgos should not state that it stores full payment-card details unless this is specifically confirmed by Finance/IT and the relevant payment setup.

7. Returns, Claims, Feedback and Supporting Evidence

When a customer submits a return request, quality claim, delivery issue or other customer-service request, Firgos may collect the order/invoice reference, customer number, contact details, reason for the request and supporting photographs, videos, batch/lot details or other evidence required to evaluate the matter.

Such information may be shared internally with the employees or departments responsible for reviewing and resolving the request. The applicable Return & Exchange Policy and claims procedures remain separate from this Privacy Policy.

8. Sharing and Access to Information

Access to customer information should be limited to Firgos personnel and service providers who require it for legitimate operational, customer-service, financial, technical, security or administrative purposes.

Firgos may also disclose information where required by applicable law, a competent authority, or where reasonably necessary to protect legal rights, prevent misuse or address security concerns.

Firgos does not intend for customer information submitted through the B2B platform to be used by employees or external parties for unrelated personal purposes.

9. Data Security

Firgos takes reasonable organizational and technical measures to protect customer and account information against unauthorized access, alteration, loss or misuse. Customers also have a responsibility to protect their login credentials and to ensure that only authorized persons use the corporate account.

No online system can be guaranteed to be completely secure. Customers should notify Firgos promptly if they suspect unauthorized access to their account.

10. Data Retention

Firgos retains information for as long as reasonably required for the purpose for which it was collected and as necessary for customer administration, order and financial records, claims, audit, security and applicable legal or regulatory requirements.

11. Cookies, Analytics and Website Technologies

FirgosCuracao.com may use cookies or similar website technologies required for functions such as account login, shopping-cart/session operation, security and website performance. Additional analytics, marketing or third-party cookies should be described based on the technologies actually enabled on the website.

12. Customer Requests and Corrections

Customers should keep their business and contact information accurate. Requests to correct or update information may be submitted to Firgos. Certain information – including legal company details, customer number, financial conditions and approved payment terms – may require internal verification and cannot necessarily be changed directly by a webshop user.

Privacy rights under Curaçao law. Under the Landsverordening bescherming persoonsgegevens (Lbp), rights relating to personal data apply to the individual person whose data is processed, including an authorized webshop user, employee, Point of Contact (POC), delivery contact or other identifiable natural person. These rights do not arise merely because an entity is a corporate customer.

An individual may request confirmation as to whether Firgos processes personal data relating to them and, where applicable, request an understandable overview of that data, the purposes of processing, the categories of data, recipients or categories of recipients, and available information concerning the source of the data. Firgos will respond in accordance with the time limits and requirements of applicable Curaçao law.

Where the applicable legal requirements are met, an individual may request that personal data be corrected, supplemented, deleted or blocked where it is factually incorrect, incomplete or irrelevant for the purpose of processing, or otherwise processed contrary to applicable law. Firgos may request adequate identification before acting on a privacy request.

An individual may also object to certain processing where the Landsverordening bescherming persoonsgegevens provides a right of objection. Where personal data is used for direct commercial or charitable solicitation, the individual may object to that use in accordance with applicable law.

Requests may be submitted through the Firgos privacy contact identified in Section 15. Firgos will assess each request in accordance with applicable Curaçao law and any legal, financial, contractual, audit or record-retention obligations that may require certain information to be retained.

13. External Links and Third-Party Services

FirgosCuracao.com may contain links to external websites or use third-party services. Where a customer leaves the Firgos website or interacts directly with a third-party service, that provider may apply its own privacy terms. Firgos customers should review the relevant third-party information where applicable.

14. Changes to This Privacy Policy

Firgos may update this Privacy Policy when its website, B2B services, systems, legal requirements or business processes change. The current version should be made available on FirgosCuracao.com with an effective or revision date.

Where a material change affects account registration or the conditions accepted by B2B users, Firgos may require users to acknowledge the updated terms or policy as part of the account-access process.
